Architectural Control Committee

The members of the Bent Tree Architectural Control Committee (ACC) are tasked with monitoring new and ongoing construction in the Bent Tree subdivision to ensure compliance with Bent Tree Covenants.

Additional Construction, Changes or Improvements

After the original construction is done, any additional construction, add-ons, sheds, fences, paving, and so on DO require the approval of the Bent Tree ACC. In addition, any changes to the exterior of your home, such as paint, new stucco, new roof, any exterior changes DO require the Approval of the Bent Tree ACC.

Softscape is dirt, plants, and trees. You do not need ACC approval for any softscape that you are putting in or taking out EXCEPT for trees. Cutting down trees that are more than 4” in diameter or greater DOES require ACC approval.

Hardscape is concrete, retaining walls, pavement, fencing, an like structures. These DO require ACC approval.

Notice about Perimeter Fences:  The Architectural Control Committee is sensitive to the ambiance of the neighborhood when approving fences, taking into account the appearance from the street and adjacent lots.  Therefore, perimeter fences will not be approved as called out in the Covenants for Bent Tree*.  A perimeter fence is any fence that follows the lot line to prevent access to wildlife or that disrupts the natural environment of the neighborhood.  A perimeter fence encloses more than 30% of the property and cannot extend the full length of any one side of the property.

* Filings 1/2 not specifically addressed.  Filing 3, Paragraph 9. E. (12) (a) and Filings 4/5, Paragraph 10. E. (12) (a):  “Barbed wire fencing within the subdivision is prohibited, and perimeter fences and chain link normally will not be approved.”

Penalty Fee for Violation: Written application for approval of plans shall be made and signed by the owner of the tract (not the builder) and the owner shall be held responsible for any violations of the covenants which are committed by the builder or other persons engaged by the owner.  If any excavation, cutting of trees or construction is commenced by owner, or owner’s representatives, prior to receipt of written approval by the ACC, then the owner agrees to pay immediately a penalty of three hundred dollars ($300).


New Construction

Before you begin any new construction on your Bent Tree lot, you will need to complete and submit the following forms.  Although you may not begin construction in any way before approval, you do need to stake out the structure on your lot so that the ACC can walk the lot and get a feel for where the structure will be built.  Submit all forms with your fee to the ACC and we will reply within 30 days.

Blueprints - These forms you supply. We need to see the plot plan and elevations for your proposed structure.
